Offer Agreement for the Purchase of an Electronic Book


1. General Provisions
1.1. This document is an official offer (public offer) by Self‑Employed Koroleva Anastasia Sergeevna, TIN 236701707682, registration address: Krasnodar Krai, Sochi, Izmailovskaya St., 200 (hereinafter – “Seller”), to conclude a purchase agreement for an electronic product with any legally capable individual (hereinafter – “Buyer”).
1.2. The text of the offer is posted at https://himlain.com/oferta/.
1.3. Acceptance of the offer is the fact of the Buyer’s payment for the Product through the payment system.

2. Subject of the Agreement
2.1. The Seller undertakes to provide the Buyer with the electronic book “Online Portrait Book: from the Fear of a Blank Page to a Conscious Drawing” in PDF format (hereinafter – “Product”), and the Buyer undertakes to pay for the Product under the terms of this offer.
2.2. The Product is digital content provided as a PDF file.

3. Purchase Procedure
3.1. The Buyer clicks the “Buy the book” button on the website https://himlain.com/, after which he is redirected to the payment system page.
3.2. Payment is made through the YooKassa service by any available method.
3.3. After successful payment, an email with a download link for the Product is automatically sent to the Buyer’s email address.
3.4. The moment of fulfillment of the Seller’s obligations is considered the sending of the email with the download link.

4. Price and Payment Procedure
4.1. The price of the Product is $50 (fifty US dollars).
4.2. Payment is made in full before receiving the Product.
4.3. Payment system fees (if applicable) are paid by the Buyer.

5. Delivery Procedure
5.1. Delivery of the Product is carried out electronically – by sending a download link to the email specified by the Buyer during payment.
5.2. The link is sent automatically within a few minutes after successful payment.
5.3. The Buyer is responsible for the accuracy of the specified email.

6. Rights and Obligations of the Parties
6.1. The Seller undertakes to:
  • Provide access to the Product after payment;
  • Ensure the technical possibility of downloading;
  • Provide support regarding purchase questions at himlainofficial@mail.ru.
6.2. The Seller has the right to:
  • Change the price of the Product;
  • Update the content of the Product without prior notice to the Buyer.
6.3. The Buyer undertakes to:
  • Provide a correct email;
  • Not distribute the Product to third parties without the Seller’s consent;
  • Use the Product for personal purposes only.
7. Return and cancellation of purchase
7.1. In accordance with Clause 14 of the Rules for the sale of goods by remote means and Article 26.1 of the Law “On Consumer Rights Protection”, digital content of proper quality is not subject to return.
7.2. A refund is possible only if the email with the download link was not sent due to technical reasons.
7.3. If the email was sent, a refund is not possible.
7.4. To request a refund, the Buyer must write to the support email himlainofficial@mail.ru and provide payment details.

8. Liability of the parties
8.1. The Seller is not liable for the inability to receive the Product due to reasons related to technical failures on the Buyer’s side (email service, email blocking, incorrect email).
8.2. The Seller is not liable for the actions of payment systems.
8.3. The Buyer is liable for distributing the Product to third parties.

9. Personal data processing
9.1. The Buyer gives consent to the processing of his personal data (email, full name, payment information) solely for the fulfillment of the terms of this agreement.
9.2. Personal data is not transferred to third parties, except for payment operators.

10. Final provisions
10.1. This offer is valid indefinitely until revoked by the Seller.
10.2. The Seller has the right to make changes to the offer without prior notice.
10.3. The legislation of the Russian Federation applies to the relations of the parties.
10.4. Posting the offer on the website himlain.ru constitutes notification of the Buyer about its terms.
